MPs Bring Issue of Internet Regulation Back on Agenda

On 11 November, the “Media and Time” programme on Ichtimai (Public) Television  held a debate on topic “Media and Verbal Culture” to discuss the freedom of speech on online media and social networks. The guests Members of Parliament (MP) Hadi Rajabli and Malahat Ibrahimgizi, head of APA Holding Vusala Mahirgizi, and head of Azerbaijan Internet Forum Osman Gunduz discussed regulation of online content.

Internet in Azerbaijan is Only "Partially Free"

Feedom House has released its annual report "Freedom on the Net 2016" evaluating internet freedom world-wide. The report notes that "internet freedom declined somewhat" in Azerbaijan concluding that internet in the country is merely partially free.

Imposition of Media Censorship during Martial Law Proposed by the Parliament

Introduction of military censorship during martial law and definition of what constitutes military censorship has been proposed by the Milli Majlis (Parliament). The proposed changes  would be included in Article 1.0.3 of the amended Law on Martial Law.

Opposition Party Activist's Detention Extended

11 November 2016

 

Nasimi District Court chaired by Judge Babak Panahov examined the petition by the prosecutor’s office to extend  pre-trial detention for Fuad Ahmadli, the chairman of Khatai district Youth Committee of the opposition party Azerbaijan Popular Front Party (APFP). According to Ahmadli’s lawyer Asabali Mustafayev, his client’s detention was prolonged by two months until 12 January 2017.

Journalist Faig Amirli’s Detention Extended by Two Months

Nasimi District Court chaired by Judge Babak Panahov heard the petition by the prosecutor’s office seeking to extendAzadliq newspaper distribution director Faig Amirli’s pre-trial detention. The court extended Amirli’s detention period for another two months until 12 January 2017.

Court Refuses to Vacate Human Rights Defender’s Conviction

8 November 2016

Baku Court of Appeal chaired by Judge Abid Abdinbayov rejected human rights defender Rasul Jafarov’s appeal seeking an early removal of his conviction. The appeal had been filed against Yasamal District Court’s decision of 2 August 2016, which denied Rasul Jafarov’s similar request.

Imprisoned Relatives of Azadliq Editor-In-Chief Publicly Disown Him

Rufat Zahidov and Rovshan Zahidov, nephew and cousin of Azadliq newspaper’s France-based editor-in-chief Ganimat Zahid, have appealed to the Ministry of Internal Affairs and the media declaring that they have disowned their relative Ganimat Zahid.

Opposition Party Activist Sentenced to 20 Days in Prison

7 November 2016

 

Vusal Zeynalov, an activist and member of the opposition party Azerbaijan Popular Front Party (APFP), was detained in Aghstafa region.  Aghstafa regional court found Vusal Zeynalov guilty for disobeying police under Article 535  of the Code of Administrative Offences, and sentenced him to 20 days in prison.

Court Dismisses Defamation Lawsuit against Journalist Miralam Hashimov

7 November 2016

 

On 7 November, Masalli Regional Court chaired by Judge Anar Almammadov held a preliminary hearing in the private prosecution brought by Rafil Huseynov, the governor of Masalli region, against journalist Miralam Hashimov. According to journalist’s lawyer Javad Javadov, the court decided that the lawsuit was unfounded.

Investigation Completed in Youth Activist’s Criminal Case

5 November 2016 

 

The preliminary investigation into the case of NIDA Civic Movement member Elgiz Gahraman has been completed. According to activist’s lawyer Fariz Namazli, the investigation has been concluded and the case will be referred to Baku Grave Crimes Court after he and his client are familiarised with the case materials.

Two Activists Arrested in Ganja for Writing a Slogan

5 November 2016

 

On 5 November, NIDA Civic Movement member Elmir Tahmin and activist Tapdig Mammadov were detained in Ganja city for spray-painting the slogan “No to Dictatorship” in Heydar Aliyev Park. On 6 November, the court sentenced them to 30 days in prison. According to the youths’ relatives, the  two men were tortured while in police custody and did not have legal representation at the time of the arrest.

Ministry of Internal Affairs: Lawyer Fariz Namazli Has Not Injured Anyone

The Ministry of Internal Affairs (MIA) confirmed that lawyer Fariz Namazli  did not cause any injury to Khatai Shahverdiyeva, a woman that accused the lawyer of assaulting her during an incident at Baku Court of Appeal where the lawyer was attacked by a group of people.

Youth Activist Bayram Mammadov Says His Statements Were Extracted under Torture

Ø The public prosecutor announced the indictment bill at the hearing. The accused - youth activist Bayram Mammadov - rejected the charges;

Ø Bayram Mammadov said he had nothing to do with drugs but had been coerced through torture to admit the drug charges during the investigation phase;

Ø Testifying at the hearing, Shirali Babayev, a detective with the Department for Combating Drugs of Baku City Police Department, and Naib Omarov, an officer for the same Department, said drugs had been found on Bayram Mammadov and at his apartment.

Ø  During his examination as a witness, Rasim Aslanov said he had been in front of Sabunchu District Police Department together with the other protesters on 5 November 2015, but had not seen anyone throw rocks at the policemen;

Ø  Afig Shukurov, an officer for Sabunchu District Police Department, testified that he had been in front of Sabunchu District Police Department on 5 November 2015, and one of the stones thrown at the police hit him in the forehead and he fainted;

Ø  Nardaran resident Tural Allahverdiyev did not confirm his statement provided to the investigating authority;

Ø  Mehman Madatov, a junior inspector with the 15th police station of Sabunchu district, testified as a witness. He said he had not seen the detainees be physically assaulted at the police station.
